1. About These Terms
These Terms apply when you use this website, submit a form, request an audit, purchase a service or work with McMahon Solutions. By placing an order or using our services, you agree to these Terms.
2. Services
Our services may include website builds, website SEO setup, Google Business Profile setup, booking system setup, CRM setup, product store setup, membership/payment flow setup, website animation, brand kit creation, free business audits, automation setup and related consultancy.
The exact services included in your order will be shown on the relevant order page, checkout, invoice, proposal or written agreement.
3. Build And Handover Model
Unless agreed otherwise in writing, services are provided on a build-and-handover basis. We build or configure the agreed service, provide reasonable handover guidance, and you own and operate your own accounts and tools after handover.
Ongoing support, maintenance, extra revisions, new features or future edits are not included unless separately agreed.
4. Client Responsibilities
- Provide accurate business information, content, images, logos, files and brand material.
- Complete onboarding forms and provide required account access.
- Ensure you have permission to use any content, images, logos, reviews or materials supplied to us.
- Review the demo and provide clear feedback.
- Test the final setup before relying on it for live business operations.
- Keep ownership of your domain, payment accounts and third-party tools.
If required information, content, access or account setup is delayed, delivery may also be delayed.
5. Third-Party Tools
Some services use tools such as Framer, Notion, Make, Stripe, GoCardless, Google Calendar, Google Business Profile or other platforms. You are responsible for creating and owning your accounts, paying third-party fees, complying with platform terms and keeping login and billing information secure.
6. Payments And Delivery
Prices are shown on the website, checkout, invoice or written agreement. Payment is required before work begins unless agreed otherwise in writing. Online payment secures your build slot and starts the onboarding process.
Delivery times are estimates and depend on the service purchased, project complexity, onboarding completion, third-party account setup and response time during review and revision. Delivery does not begin until payment, onboarding, required content, files and access are complete.
7. Revisions
Unless agreed otherwise, one reasonable revision round is included after the demo. Major design direction changes, new pages, new functionality, new integrations, rebuilding approved work or changes caused by missing/incorrect information may require a new quote.
8. Client Content And IP
You confirm that you have the right to use any content, images, logos, reviews, trademarks or files supplied to us. Once full payment has been received, you may use the final delivered website, assets or setup for your own business purposes. We may reuse general methods, templates, layouts, components, processes and non-client-specific know-how in future work.
9. Portfolio Use
Unless you ask us not to in writing, we may mention your business name and show screenshots or summaries of completed work in our portfolio, marketing or social content.
10. Free Business Audit And Results
The free business audit provides general observations about business setup, bottlenecks, weak points and inefficiencies. It is not legal, financial, accounting, tax or regulated professional advice. We do not guarantee specific revenue, rankings, leads, sales, traffic, conversion rates or business outcomes.
11. Liability And Termination
We are not responsible for losses caused by incorrect information supplied by you, third-party platform failures, missed leads caused by failure to monitor systems, loss of revenue/profit/opportunity, indirect losses or issues caused by changes made after handover. Nothing in these Terms limits liability where it would be unlawful to do so.
We may pause or stop work if payment is not made, required information or access is not provided, the project becomes materially different from what was ordered, communication becomes abusive or impossible to manage, or continuing would create legal, ethical, security or operational risk.
12. Governing Law
These Terms are governed by the laws of Scotland, unless another jurisdiction is required by law.
